Your acceptance of this Privacy Policy is deemed to occur upon your first use of our Site AND/OR you will be required to accept this Privacy Policy when providing us with personal data. If you do not accept and agree with this Privacy Policy, you must stop using our Site immediately and you should not provide any personal data.

In this Policy the following terms shall have the following meanings:

“Cookie” means a small text file placed on your computer or device by our Site when you visit certain parts of our Site and/or when you use certain features of our Site.   • The right to data portability. This means that, if you have provided personal data to us directly, we are using it with your consent or for the performance of a contract, and that data is processed using automated means, you can ask us for a copy of that personal data to re-use with another service or business in many cases.

6. What Data Do We Collect?
We may collect some or all of the following personal data and non-personal data (please also see Part 14 on our use of Cookies and similar technologies):

  • Any information included on your CV or cover letter;
  • The type of roles you are interested in;
  • Your ideal locations and potential re-location information;

  • Whether you hold a full UK driving license;
  • Information to support your job application;
  • Emergency contact information e.g. Next of kin;
  • National Insurance number;
  • Work history and employment records;
  • Documents to prove your eligibility to work in the UK, e.g. your passport or other relevant documents as proof;
  • Bank account details or other relevant documentation;
  • Information supplied to us to support the recruitment process

Your personal data may also be obtained from the following third parties:

  • Our clients;
  • Companies where you are contracted to work;

7. How Do You Use My Personal Data?
Under the GDPR, we must always have a lawful basis for using personal data. This may be because the data is necessary for our performance of a contract with you, because you have consented to our use of your personal data, or because it is in our legitimate business interests to use it. Your personal data may be used for the following purposes:

  • In order for us to provide a recruitment service to you.
  • In order for us to send you vacancies that may interest you.
  • In order for us to send job specifications to you that match your requirements.
  • In order for us to check that you are eligible to work in the UK.
  • For certain legal obligations, we may need to share your data with Government bodies.
  • Communicating with you. This may include responding to emails or calls from you;
  • Internal record keeping and job applications;
  • We may use the information to improve our products and services;

We will always work to fully protect your rights and comply with our obligations under the GDPR and the Privacy and Electronic Communications (EC Directive) Regulations 2003, and you will always have the opportunity to request opt-out.

Third Parties whose content appears on our Site may use third-party Cookies, as detailed below in Part 14. Please refer to Part 14 for more information on controlling cookies. Please note that we do not control the activities of such third parties, nor the data that they collect and use themselves, and we advise you to check the privacy policies of any such third parties.

We use the following automated system for carrying out certain kinds of decision-making AND/OR profiling. If at any point you wish to query any action that we take on the basis of this or wish to request ‘human intervention’ (i.e. have someone review the action themselves, rather than relying only on the automated method), the GDPR gives you the right to do so. 8. How Long Will You Keep My Personal Data?
We will only keep your personal information for as long as reasonably necessary to fulfil the relevant purposes set out in this Privacy Policy and in order to comply with our legal and regulatory obligations. The time period we retain your personal information for will differ depending on the nature of the personal information and what we do with it. How long we keep personal information is primarily determined by our regulatory obligations. We are legally obliged to retain the following types of data for 1 year from the date we ceased providing a service to you:

name, address and, if under 22, date of birth

any terms which apply, or will apply, between the agency or employment business and you

any document recording changes to these terms

details of your training, experience and qualifications and any authorisation to do particular types of work (and copies of any documents provided to us relating to this)

details of any resulting engagements and when they start

a copy of any contract between you and a hirer that we entered into on your behalf

details of enquires about you and the position concerned (including copies of all relevant documents and dates they were received or sent)

9. How and Where Do You Store or Transfer My Personal Data?
We may share your data with external third parties, as detailed below in Part 10, that are based outside of the United Kingdom. The following safeguard is applied to such transfers:

The security of your personal data is essential to us, and to protect your data, we take a number of important measures, including making sure the standard of their data protection is equivalent to ours.

  • Our clients – we will share your CV information and/or cover information as well as any stipulated job requirements in order for our clients to choose their candidates. If successful, we will pass on the necessary contact details such as address details, email addresses, date of birth, contact numbers and references.
  • We may potentially share your personal information with any companies where you are contracted to work
  • The Department of Employment
  • Any government bodies where we are required to share your personal information by law. For example: HMRC
  • We may share your personal information with other third- parties who provide particular services on our behalf
  • We have processes in place which align with our clients, and suppliers. This ensures that our third – parties all take the appropriate and efficient steps to ensure maximum security procedures are in place to protect your personal information.
  • We never allow our third - parties to use your personal data for any other reason than what is outlined above.

In some cases, those third parties may require access to some or all of your personal data that we hold. We do not disclose your information to anyone outside Finrec Ltd except:

  • where we have your permission; or
  • where we are required or permitted to do so by law or by regulatory bodies; or
  • to other companies who provide a service to us or you; or
  • where it is necessary for the performance of an agreement we have with you; or
  • where we may transfer rights and obligations under this agreement

If any of your personal data is required by a third party, as described above, we will take steps to ensure that your personal data is handled safely, securely, and in accordance with your rights, our obligations, and the third party’s obligations under the law, as described above in Part 9.

If any personal data is transferred outside of the United Kingdom, we will take suitable steps in order to ensure that your personal data is treated just as safely and securely as it would be within the UK and under the GDPR, as explained above in Part 9.

In some limited circumstances, we may be legally required to share certain personal data, which might include yours, if we are involved in legal proceedings or complying with legal obligations, a court order, or the instructions of a government authority.

11. How Can I Control My Personal Data?
In addition to your rights under the GDPR, set out in Part 5, when you submit personal data via our Site, you may be given options to restrict our use of your personal data. In particular, we aim to give you strong controls on our use of your data for direct marketing purposes (including the ability to opt-out of receiving emails from us which you may do by calling us on the number mentioned in Part 15 or on the claims form we send out to you.

You may also wish to sign up to one or more of the preference services operating in the UK: The Telephone Preference Service (“the TPS”), the Corporate Telephone Preference Service (“the CTPS”), and the Mailing Preference Service (“the MPS”). These may help to prevent you receiving unsolicited marketing. Please note, however, that these services will not prevent you from receiving marketing communications that you have consented to receiving.

12. Can I Withhold Information?
In most cases we will not be able to provide a recruitment service to you without you providing us with certain personal data.

You may access certain areas of our Site without providing any personal data at all. However, to use all features and functions available on our Site you may be required to submit or allow for the collection of certain data.

13. How Can I Access My Personal Data?
If you want to know what personal data we have about you, you can ask us for details of that personal data and for a copy of it (where any such personal data is held). This is known as a “subject access request”.

All subject access requests should be made in writing and sent to the email or postal addresses shown in Part 15. There is not normally any charge for a subject access request. If your request is ‘manifestly unfounded or excessive’ (for example, if you make repetitive requests) a fee may be charged of £10.00 to cover our administrative costs in responding.

We will respond to your subject access request within one month and, in any case, not more than one month of receiving it. Normally, we aim to provide a complete response, including a copy of your personal data within that time. In some cases, however, particularly if your request is more complex, more time may be required up to a maximum of three months from the date we receive your request. You will be kept fully informed of our progress.

14. How Do You Use Cookies?
Our Site may place and access certain first-party Cookies on your computer or device. First-party Cookies are those placed directly by us and are used only by us. We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system. We have carefully chosen these Cookies and have taken steps to ensure that your privacy and personal data is protected and respected at all times.
